TERMS & CONDITIONS OF THE “DOGSPOT” MOBILE APPLICATION

1. General Provisions

1. These Terms & Conditions ("Terms") set out the rules for using the “DogSpot” mobile application ("Application") provided by MatCode Mateusz Arczyński, conducting business under the name MatCode Mateusz Arczyński, NIP 875-156-25-99, e-mail: matcode.help@gmail.com ("Service Provider").

2. By installing the Application or starting to use it, the User enters into an agreement for the provision of electronic services with the Service Provider under the conditions specified in these Terms.

3. Before using the Application, the User is obliged to read and accept these Terms. Lack of acceptance prevents the use of the Application.

2. Technical Requirements

1. The Application requires a mobile device with:

a) Android 8.0 or newer, or

b) iOS 14.0 or newer,

and an active Internet connection.

2. The Service Provider does not guarantee proper operation of the Application on devices that have been jailbroken, rooted, or have custom software installed.

3. License and Intellectual Property Rights

1. The Service Provider grants the User a non-exclusive, non-transferable, and revocable license to use the Application solely for its intended purpose and in accordance with these Terms.

2. Nature of the Service: DogSpot is strictly a technology platform facilitating connections between dog owners. The Service Provider does not organize, supervise, or control the "Pack Walks" or any real-world meetups.

3. User Liability: The User is solely legally and financially responsible for their dog's behavior. The Service Provider shall not be liable for any physical injury, dog bites, damage to property, or emotional distress resulting from real-world meetings arranged through the Application.

4. No Background Checks: The Service Provider does not verify the identity, criminal background, or dog handling skills of Users, nor do we verify the vaccination status or true temperament of the dogs. Users meet at their own absolute risk.

5. Social Login and Notifications

1. The Application offers the ability to log in using third-party services (Apple, Google). By choosing this method, you authorize the Service Provider to receive and store basic profile information (e.g., email address, account ID) strictly for authentication and account creation purposes.

2. The Application may send you push notifications (e.g., for messages or walk updates) if you grant permission within your device settings. You can manage or disable these notifications at any time in your OS settings.

6. User Account and Community Rules

1. The User declares that any dog they add to the Application and bring to a meetup is fully vaccinated (including mandatory rabies vaccinations) and does not possess a history of unprovoked aggression.

2. The User must comply with all local laws during meetups, including leash laws, muzzle requirements for specific breeds, and waste cleanup regulations.

3. The Service Provider reserves the right to moderate content, remove dog profiles, or permanently ban Users without prior notice if they exhibit abusive behavior, receive reports of dangerous dog behavior, or violate these Terms.

7. Fees

1. The basic functionality of the Application is provided free of charge.

2. The Service Provider will not charge the User any fees without prior, explicit information about the amount and scope of the fees.

8. Updates and Termination

1. The Service Provider may introduce updates to improve security, functionality, or performance of the Application; the User agrees to install them.

2. The User may stop using the Application at any time by uninstalling it from their device and deleting their account via the in-app settings.

9. Changes to the Terms

1. The Service Provider reserves the right to amend the Terms. The amended Terms will be made available in the Application and on the Service Provider’s website no later than 14 days before they take effect.

2. Continued use of the Application after the effective date of changes constitutes acceptance of the new Terms.

10. App Store / EULA Addendum (Apple Devices Only)

1. Acknowledgment: The User and Service Provider acknowledge that these Terms are concluded between the User and the Service Provider only, and not with Apple Inc. (“Apple”). The Service Provider, not Apple, is solely responsible for the Application and the content thereof.

2. Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

3. Liability: To the maximum extent permitted by applicable law, Apple will have no warranty obligation whatsoever with respect to the Application. Apple is not responsible for addressing any claims by the User or any third party relating to the Application, including product liability claims, failure to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.

11. Final Provisions and Contact

1. Matters not regulated by these Terms are governed by Polish law.

2. Any disputes arising from the agreement will be resolved by the competent common court.
