TERMS & CONDITIONS OF THE “GYMPAD” MOBILE APPLICATION

1. General Provisions

1. These Terms & Conditions ("Terms") set out the rules for using the “GymPad” mobile application ("Application") provided by MatCode Mateusz Arczyński, conducting business under the name MatCode Mateusz Arczyński, NIP 875-156-25-99, e-mail: matcode.help@gmail.com ("Service Provider").

2. By installing the Application or starting to use it, the User enters into an agreement for the provision of electronic services with the Service Provider under the conditions specified in these Terms.

3. Before using the Application, the User is obliged to read and accept these Terms. Lack of acceptance prevents the use of the Application.

2. Technical Requirements

1. The Application requires a mobile device with:

a) Android 8.0 or newer, or

b) iOS 14.0 or newer,

and an active Internet connection.

2. The Service Provider does not guarantee proper operation of the Application on devices that have been jailbroken, rooted, or have custom software installed.

3. License and Intellectual Property Rights

1. The Service Provider grants the User a non-exclusive, non-transferable, and revocable license to use the Application solely for its intended purpose and in accordance with these Terms.

2. In particular, the User is prohibited from:

copying or modifying the Application or its components;
reverse engineering, decompiling, or attempting to obtain the source code;
creating derivative works based on the Application;
using the Service Provider’s trademarks in a manner contrary to law or good practice.

3. All intellectual property rights to the Application and trademarks remain with the Service Provider and are protected by copyright law, industrial property law, and international agreements.

4. Third-Party Services

1. The Application uses third-party services, each of which has its own terms of use. Links to the terms of use of third-party services used by the Application:

2. The Application and any training forecasts generated within it are for informational purposes only and do not constitute medical or dietary advice. Results may vary depending on the User’s individual predispositions and health. Before making changes to a training plan, the User should consult a doctor or qualified trainer. Use of these forecasts is at the User’s sole risk.

3. The Service Provider strives to ensure the proper functioning of the Application but is not liable for:

malfunctions resulting from lack of or limited Internet access;
consequences of using the Application on a device with low battery level;
damage caused by the User’s violation of these Terms;
any direct or indirect losses resulting from reliance on content entered into the Application.

4. When using the Application outside a Wi-Fi network, the User bears data transmission costs according to their operator’s tariff. The Service Provider is not responsible for these costs.

5. User Account and Subscriptions

1. Registering an account automatically grants a free Premium package for 30 days ("Trial Period"). After the Trial Period, the account is converted to Standard unless the User purchases a Premium subscription at the current price list.

2. A Standard account allows a maximum of:

30 workouts,
3 training plans.

After exceeding the limit, adding more items will not be possible until existing ones are deleted.

3. A Premium account has no workout limit and allows storing up to 15 training plans simultaneously.

4. If the Premium subscription expires:

excess plans will be blocked (they remain saved but unavailable for editing);
the User can only use Standard account limits.

5. Deleting a workout or plan is irreversible and results in permanent data deletion.

6. Fees

1. The Application is provided free of charge. Selected Premium features may be paid according to the price list presented in the Application before purchase.

2. The Service Provider will not charge the User any fees without prior, explicit information about the amount and scope of the fees.

7. Updates and Termination

1. The Service Provider may introduce updates to improve security, functionality, or performance of the Application; the User agrees to install them.

2. The Service Provider may discontinue the Application or part thereof, notifying Users 30 days in advance. After termination, the User should remove the Application from their device.

3. The User may stop using the Application at any time by uninstalling it from their device.

8. Changes to the Terms

1. The Service Provider reserves the right to amend the Terms. The amended Terms will be made available in the Application and on the Service Provider’s website no later than 14 days before they take effect.

2. Continued use of the Application after the effective date of changes constitutes acceptance of the new Terms.

9. Final Provisions and Contact

1. Matters not regulated by these Terms are governed by Polish law.

2. Any disputes arising from the agreement will be resolved by the competent common court.
